Statement on the processing of personal data in accordance with GDPR

• The Company ‘AGAT’ S.A. with its registered office in Koluszki, Paderewskiego 1 street (hereinafter: AGAT S.A.), informs that it is the controller of your personal data.

• Your personal data is processed for the following purposes:
  • taking action to conclude and perform agreements to which you are a party,
  • handling, claiming and defending in the event of counterclaims.
• The legal basis for the processing your personal data by AGAT S.A. for the purposes indicated in section 2 above is:
  • taking action to conclude and implement the agreements (in accordance with art. 6 section 1 letter b of GDPR) to which you are a party;
  • compliance with legal obligations (in accordance with art. 6 section 1 letter c of GDPR) related to the payment of taxes, including the keeping and storage of tax records and documents related to keeping tax records and storage of bookkeeping vouchers. The legal basis for data processing are the legal obligations arising from tax legislation (Tax Ordinance, Act on the value added tax, Corporate Income Tax Act) and accounting regulations (Accounting Act).
  • legitimate interest of AGAT S.A. (in accordance with art. 6 section 1 letter f of GDPR) – for the purpose of handling, claiming and defending in the event of counterclaims;
• Your personal data may be disclosed by AGAT S.A. to the entities cooperating with it (recipients), in particular to the entities providing services of invoicing, settlement of receivables, delivery of correspondence and shipments, collection and archiving and legal services.
• Your personal data is processed for the duration of the agreement, as well as until the expiry of the counterclaims arising from the agreement.
• Providing personal data was and is voluntary, but necessary for the conclusion and performance of the agreement.
• You have the following rights in connection with the processing of your personal data:
  • right of access to the content of your data,
  • right to request rectification or erasure of your personal data,
  • right to restrict the processing of your personal data,
  • right to data portability, i.e. the right to receive personal data from AGAT S.A., in a structured, commonly used machine-readable IT format. You can transfer this data to another data controller or request that AGAT S.A. send the data to another controller. However, AGAT S.A. will only do so if such transfer is technically possible. The right to transfer personal data is only available to the data processed on the basis of the agreement concluded with you,
  • right to object – in case when the processing of your personal data by AGAT S.A. is carried out on the basis of a legitimate interest; given the abnormal situation, the object can be sent via e-mail: biuro@agat-koluszki.pl or by post to the address of the registered office of AGAT S.A.  with the notation: ‘Data Protection’.
• You have the right to lodge a complaint with the Chairman of the Personal Data Protection Office.
